Trump’s ICE CAUGHT IN A LIE over ARRESTS!?!?

Attorneys Brian Kabateck and Shant Karnikian break down the DOJ’s admission that it “respectfully and regrettably” misrepresented a “material fact” to a federal judge for over a year. ICE had been arresting noncitizens inside Manhattan immigration courthouses as they showed up for hearings, sometimes pulling them away from family members in hallways. The DOJ defended the practice by citing a May 2025 ICE memo. Judge P. Kevin Castel relied on that representation and denied a preliminary injunction in September 2025. Turns out the memo never applied to immigration courts. It only covered criminal courthouses. DOJ attorneys learned the truth when ICE finally admitted the error, prompting a letter to the judge withdrawing portions of four briefs and retracting multiple statements made during oral arguments. Judge Castel reversed course, issuing a temporary restraining order blocking ICE from conducting civil immigration arrests at three Manhattan courthouses and reserving the question of sanctions. DHS responded by criticizing the judge and insisting “we will continue to arrest illegal aliens at immigration courts.” Brian and Shant note the pattern: aggressive enforcement first, legal justification fabricated after the fact, then courts catching up and shutting it down. The ACLU called it “another example of ICE’s brazen disregard for the lives of immigrants.”
