Attorneys Brian Kabateck and Shant Karnikian cover Transportation Secretary Sean Duffy’s return to reality TV. Duffy, who got his start on MTV’s The Real World: Boston in 1997, spent seven months filming “The Great American Road Trip,” a five-part YouTube series with his wife Rachel Campos-Duffy and their nine kids traveling across 10 states. The show was funded by a 501(c)(4) nonprofit backed by Boeing, Toyota, United Airlines, Shell, Royal Caribbean, and Enterprise, all companies regulated by the Department of Transportation. CREW filed an Inspector General complaint. When Democratic senators grilled Duffy at a Senate Appropriations hearing, he responded with whataboutisms about their campaign donors and asked Senator Murray if she “hates America.” Sen. Patty Murray was direct: “Toyota, United Airlines, Shell, Boeing, Royal Caribbean and Enterprise all sponsored your show.” Duffy had no answer. Brian and Shant note the tone-deafness of promoting a road trip while Americans pay $7 a gallon for gas, and the deeper conflict of interest problem: Boeing, which the FAA regulates after two fatal 737 MAX crashes, is the show’s top-level sponsor. Duffy claims ethics officials cleared him and no taxpayer dollars were used, but the nonprofit doesn’t have to disclose donors because of its tax-exempt structure.
