Trump FORCED to PAY by Supreme Court

Attorneys Brian Kabateck and Shant Karnikian cover the financial fallout from the Supreme Court’s tariff ruling. After the court struck down Trump’s tariffs 6-3 in February, the U.S. Court of International Trade has now ordered the federal government to refund $166 billion to American importers — with interest. The refund order confirms what everyone knew all along: these tariffs were never paid by foreign countries. They were paid by American businesses and passed on to American consumers. About 57,000 importers — including major companies like Amazon and FedEx — have already pre-registered claims totaling roughly $127 billion of the $166 billion owed. According to the Cato Institute’s Scott Lincicome, the government is now accruing $22 million per day in interest, or $650 million per month, until the refunds are paid out. The administration has set up a portal for claims with a 60-to-90-day payment timeline, but Brian and Shant warn it will be like pulling teeth — the Trump administration will find every excuse to minimize and delay refunds. Trump’s reaction to the Supreme Court ruling was to lament that the justices couldn’t at least let him keep the money, while calling them disloyal and an embarrassment to their families. Brian and Shant note the broader constitutional significance: the decision draws clear lines limiting presidential emergency powers on trade and gives courts authority to force the government to unwind illegal policies and make people whole.
