Trump DOUBLES DOWN on Spying Powers as He SPIRALS
Attorneys Brian Kabateck and Shant Karnikian break down the battle over Section 702 of the Foreign Intelligence Surveillance Act, which expired April 20 and received only a 10-day extension to April 30 after 20 Republicans joined Democrats in blocking Trump’s push for a clean 18-month renewal. Section 702 allows U.S. intelligence agencies to collect communications of foreign targets abroad without a warrant — but Americans’ calls, texts, and emails routinely get swept up in the process, and under current law, the FBI can search that data without a warrant. The FBI conducted 3.4 million warrantless searches of Americans’ communications in 2021 alone. A bipartisan coalition led by Senators Mike Lee and Dick Durbin is demanding a simple reform: require a warrant before searching Americans’ communications collected under the program, and ban the government from purchasing Americans’ data from brokers without a court order. Trump wants none of it. Brian and Shant explain why this should terrify everyone — particularly with this administration’s track record of political retribution. They also flag the AI dimension: with emerging technology, warrantless access to this data could allow the government to build comprehensive profiles of any American in seconds. Sen. Ron Wyden called the latest extension bill “a rubber stamp for Trump and Kash Patel to spy on Americans without a warrant.”
