Supreme Court FACE Ethics BOMBSHELL
Attorneys Brian Kabateck and Shant Karnikian are joined by Gabe Roth, executive director of Fix the Court, the nonpartisan nonprofit that has spent over a decade tracking undisclosed gifts, conflicts of interest, and ethics failures at the Supreme Court. The conversation covers three major issues. First, the King Charles state dinner: Roth says if you invite one justice, you invite all nine, calling it a “lesson you learn in kindergarten.” He notes the six conservative justices should have declined in solidarity with the three who weren’t invited, because the Constitution establishes “one Supreme Court,” not a 6-3 split on who gets to attend a party. Second, the shadow docket: Roth outlines Fix the Court’s legislative proposal requiring justices to explain their emergency rulings by listing the four traditional factors for a stay, and suggests Congress use its power of the purse to enforce compliance, noting there’s roughly $100 million in discretionary Supreme Court funding that can be conditioned on reforms. Third, prediction markets: Roth reveals that Fix the Court has formally asked the Supreme Court and lower courts to ban judges, justices, and staff from using platforms like Polymarket and Kalshi, where users can bet on case outcomes, justice retirements, and pending rulings. Law clerks and justices know these outcomes before the public. The Senate already unanimously banned its own members from prediction markets, and a U.S. soldier was criminally charged for profiting off the Iran invasion. Roth also previews upcoming budget testimony by Justices Kagan and Barrett before the Senate, their first appearance on the Hill in years, and predicts Thomas and Alito will retire before 2029.
